• South Dakota law requires campaigns to collect and report the donor’s name, mailing address, city, and state for every contribution. Anonymous donations cannot be kept and must be donated to charity.
• Campaign funds are never used for personal spending.
• Donated goods and services also count toward contribution limits under South Dakota law.
• For South Dakota legislative or county candidates, individuals and businesses/entities may contribute up to $1,000. Statewide candidates have a limit of $4,000.
• Immediate family members of a candidate (and the candidate themselves) may contribute unlimited amounts to that candidate.
• Contributions from foreign governments, federal agencies, state agencies, or political subdivisions of government are prohibited.
• South Dakota campaign finance complaints and enforcement processes are governed under SDCL 12-27-47 and 12-27-47.1.
• Campaign finance statutes referenced in the document include SDCL 12-27-7, 8, 9, 10, and 18.1.
